Asking The Difficult Questions

  • What kind of malpractice is involved in your injury? Your injury may have been caused by errors in diagnosis, drug prescription, surgery, or breakdowns in communication within a hospital or clinic.
  • What was your health like before the injury? Unfortunately, many cases involve clients who were in poor health before the alleged medical malpractice. Even if your injuries are catastrophic, or involve brain or spinal damage, the other side may claim that the damage is due to your condition, not the treatment.
  • What is the effect on your quality of life? The defence may claim that even if the results of a procedure aren’t what you hoped for, you are no worse off than you would have been without treatment.
  • What would a reasonable medical practitioner have done? Unfortunately, this may sometimes be a very subjective judgment. Unless your medical practitioner was very incompetent, it may not be easy to prove that he or she acted unreasonably.
  • Is the case worth it for you? You deserve to know what will be asked of you if you take part in what may be a long, difficult case, so that you can make the best decision for your own health.
